Sigma Cloud Terms of Use

(hereinafter referred to as SIGMA-ELEKTRO GMBH, we or our) in respect of the SIGMA DATA CLOUD Service including related software (hereinafter the “service”). Before using the service, please read and accept these Terms of Use and the Data Privacy Statement available at:

1. The SIGMA DATA CLOUD Service.
The service offers features and functionality with which you can exclusively store your files from other SIGMA software solutions such as SIGMA DATA CENTER or SIGMA MOVE APP and synchronise (your files) on different terminal devices. By using this service, you instruct us to store and manage your files and to grant you access to your files on your behalf for the purposes of implementing the relevant synchronisation of your various terminal devices.
SIGMA DATA CLOUD Service is permitted to be used only for private purposes. Any commercial use by you or by a third party is prohibited. Likewise, use with any software other than the SIGMA software solutions is prohibited.
Use of the SIGMA DATA CLOUD Service requires Internet access for all terminal devices that have to be synchronised. Its provision as well as the necessary terminal devices and the other SIGMA software solutions are not the subject of this agreement.
2. Start and duration of use of the SIGMA DATA CLOUD Service
SIGMA-ELEKTRO GMBH offers the SIGMA DATA CLOUD to you as a free service. The contract is concluded with your registration and confirmation of activation by SIGMA-ELEKTRO GMBH, at the latest with the provision of the service. To register, we only need your name and email address. Your access is protected by a password separately selected by you. Please inform us about changes to your contact details.
The use of SIGMA DATA CLOUD Service is for an unlimited period of time (subject to the other provisions of these terms of use).
3. Scope and limitations of use of the SIGMA DATA CLOUD Service
SIGMA DATA CLOUD is available worldwide. We can restrict access from other locations. There can be limitations on the number or type of devices you can use to access the service.
SIGMA DATA CLOUD Service is a free service. It is normally available for you 24 hours a day. However we cannot provide any guarantee for that. Downtime can be the caused due to necessary maintenance.
You can store up to 5,000 data sets via SIGMA DATA CLOUD. If you exceed the storage capacity of your service package, you may no longer be able to access your files.
You will be able to use your service package only in conjunction with a SIGMA DATA CLOUD Service account. You should not reveal your SIGMA DATA CLOUD Service user names and password to other people and keep the access data protected against access by third parties. Access data should be stored only in encrypted form on electronic storage media (e.g. tablet, smart phone, PC, USB stick).
SIGMA DATA CLOUD Service is a free service and is not intended for the storage of your data on the long term. We expressly point out that you should save your data yourself regularly, for example, on any of your terminal devices.
4. Information on data access by SIGMA-ELEKTRO GMBH
SIGMA-ELEKTRO GMBH may use subcontractors to provide the SIGMA DATA CLOUD Service. The location of the servers used for the provision of the SIGMA DATA CLOUD Service is within the European Union. For the provision of the SIGMA DATA CLOUD Service, SIGMA-ELEKTRO GMBH may also create backup copies of the data. SIGMA-ELEKTRO GMBH respects your privacy. SIGMA DATA CLOUD Service can collect information about your usage and performance of the services. This information may comprise, for example, the type of device, the mobile network connection, the device’s IP address, information about your ISP, information as to when the software is started, individual session lengths of the use of the service, information about the content used via the service, or the occurrence of technical errors. Any information that we receive is subject to the Data Privacy Statement of www.sigma-data-cloud.com
5. Statistical evaluation
SIGMA-ELEKTRO GMBH may evaluate the data for statistical purposes. Here, it is ensured before the start of the evaluation that an inference from the evaluated data of the individual customers is excluded by suitable anonymisation.
6. Software updates
SIGMA-ELEKTRO GMBH offers at irregular intervals software updates for your terminal devices for other SIGMA software solutions, but possibly also for SIGMA DATA CLOUD. You are automatically notified and can decide whether you want to use them or not. Not using the updates can limit the functionality of SIGMA DATA CLOUD Service still more, or in some cases the service cannot be used any longer.

There you will also know more about the types of measures that we adopt to respond to potential security or integrity incidents or threats and vulnerabilities.
8. Termination of the use of the SIGMA DATA CLOUD Service
You can stop using the SIGMA DATA CLOUD at any time by unsubscribing from the service. At the “sigma-data-cloud.com” site, you can also permanently delete your data stored under the SIGMA DATA CLOUD Service.
SIGMA-ELEKTRO GMBH reserves the right to stop or limit the SIGMA DATA CLOUD Service after giving an appropriate notice of at least 14 days on the sigma-data-cloud.com website.SIGMA-ELEKTRO GMBH intends, in such a case, to also send the appropriate information to the email address provided by you.
SIGMA-ELEKTRO GMBH also reserves the right to stop the SIGMA DATA CLOUD Service to you at any time, especially if there has been a breach of essential contractual obligations on your part.
After the effective date of termination or upon termination of the SIGMA DATA CLOUD Service, your entire database will be deleted.
9. Liability
SIGMA-ELEKTRO GMBH is not liable, as a free service, for longer-term storage, the accuracy and completeness of the stored and/or transmitted files. The unlimited liability for damages resulting from injury to life, body or health remains unaffected by this, such as the liability for intentional or grossly negligent breach of duty or liability under the Product Liability Act.

11. Miscellaneous
If you intend to initiate, in the event of a dispute with SIGMA-ELEKTRO GMBH, an arbitration process pursuant to § 47a TKG at the Federal Network Agency, you have to send a request to the Federal Network Agency in Bonn.
